1. Acceptance of Terms

By accessing or using TopMarks (topmarks.com.ng), you agree to be bound by these Terms of Use. If you do not agree, please do not use the platform. These terms apply to all visitors, registered users and premium subscribers.

2. The Service

TopMarks provides an online exam preparation service for Nigerian students preparing for WAEC and JAMB examinations. The platform offers exam-standard practice questions, step-by-step explanations and study tools.

We offer two tiers of access:

  • Free tier — access to a limited number of practice sets, supported by advertisements.
  • Premium tier — full access to all questions and features, ad-free, on a paid subscription.

3. Account Registration

To access practice content you must create a free account. You agree to:

  • Provide accurate and truthful information when registering.
  • Keep your password confidential and not share your account with others.
  • Notify us immediately if you believe your account has been compromised.
  • Be at least 13 years old, or have the consent of a parent or guardian.

You are responsible for all activity that occurs under your account.

4. Subscriptions and Payments

Membership is billed every 30 days and renews automatically until you cancel. By subscribing you authorise us to charge the then-current fee to your payment method at the start of each period.

You may cancel at any time from your account settings. Cancellation stops future charges; it does not end the period you have already paid for, and you keep premium access until that period expires.

We will tell you by email before any price change takes effect, and you may cancel before it does.

Payments are processed securely by Paystack. We do not offer refunds for partial periods, and we do not store your card details.

5. Acceptable Use

You agree not to:

  • Copy, reproduce, distribute or resell any content from TopMarks without written permission.
  • Use automated tools (bots, scrapers) to extract questions or solutions in bulk.
  • Attempt to reverse-engineer, hack or disrupt the platform.
  • Share your account credentials or allow others to use your subscription.
  • Post or transmit any unlawful, offensive or harmful content.
  • Impersonate any person or organisation.

We reserve the right to suspend or terminate accounts that violate these rules without notice or refund.

6. Intellectual Property

All content on TopMarks — including questions, solutions, explanations, graphics and software — is the property of TopMarks or its licensors and is protected by applicable copyright laws. You may use the content solely for your personal, non-commercial study purposes.

Past examination questions are the property of their respective examination bodies (WAEC, JAMB). TopMarks's original contributions include the step-by-step solutions, explanations and tips.

7. Disclaimers

TopMarks is provided "as is" without warranties of any kind. We do not guarantee that using the platform will result in any particular exam score or grade. Past questions are provided for practice purposes and may not perfectly reflect current examination formats.

We make every effort to ensure solutions are accurate, but errors may occur. If you spot an error, please report it to info@topmarks.com.ng.

8. Limitation of Liability

To the maximum extent permitted by Nigerian law, TopMarks shall not be liable for any indirect, incidental or consequential damages arising from your use of the platform. Our total liability to you shall not exceed the subscription fees you paid in the 3 months preceding any claim.

9. Governing Law

These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of the Nigerian courts.

10. Changes to These Terms

We may update these terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, notify registered users by email. Continued use of TopMarks after changes constitutes acceptance of the updated terms.
